Land Disturbing Activity Permit Requirements

The Land Disturbing Activity (LDA) code regulates clearing and grading activities and is based on minimum thresholds. The thresholds outlined in code applies to the total area to be cleared for the development project. This includes; clearing for site preparation, proposed yard and landscaping, access for construction equipment, installation of power lines, water lines, well construction, installation of on-site sewage disposal systems, sidewalk construction and driveway construction. Grading quantities for the project or environmental impacts can also trigger the need for a LDA permit.

An LDA permit is required if one or more of the following is proposed:

  • More than 2,000 square feet of new and /or replaced impervious surface will be created by the proposal
  • Clearing/grading is greater than 7,000 square feet
  • Clearing/grading activity alters an existing drain course/pattern
  • Clearing is proposed less than 2 feet from a property line
  • Grading volumes include more than 100 cubic yards within 18 month period without an associated building permit application
  • Any disturbance within a critical area and/or buffer

Impervious surface are surfaces that can’t absorb water and increase runoff, roads, driveways, sidewalks, rooftops, parking areas are considered impervious surfaces. Impenetrable materials such as asphalt, concrete, brick and stone including soils compacted by development are also highly impervious.
